Pre-Booked Parking Terms and Conditions

These Terms and Conditions ("Terms") govern the purchase and use of the Pre-Booked Parking product ("Pre-Booking") provided by Smart Parking Technologies Ltd ("SPT", "we", "us", or "our") through the SPT ParkEasy mobile application ("App"), associated websites, and participating parking facilities.

By purchasing, accessing, or using a Pre-Booking, you agree to be bound by these Terms.

1. Pre-Booking Product

1.1 The Pre-Booking product allows customers to reserve parking for a specified vehicle at a participating parking facility for a defined start date and time and end date and time.

1.2 A Pre-Booking is valid only for the vehicle registration specified during the booking process.

1.3 A Pre-Booking is valid only for the parking facility, date, and time period specified in the booking confirmation.

1.4 A valid booking confirmation constitutes proof of purchase and may be required for verification purposes.

1.5 SPT reserves the right to refuse, cancel, amend, or correct any booking where a technical error, pricing error, fraud, misuse, payment issue, operational issue, or system malfunction has occurred.

2. Parking Rights and Usage Restrictions

2.1 A Pre-Booking permits one (1) vehicle entry and one (1) vehicle exit during the booked parking period.

2.2 Once the vehicle exits the parking facility, the booking shall be deemed fully utilised and may not be reused.

2.3 Re-entry after exit is not permitted unless expressly stated otherwise by SPT.

2.4 A Pre-Booking grants access to parking facilities only during the booked period and does not guarantee access outside of those times.

2.5 Customers may park in any available parking space within the designated parking facility unless a specific parking area, parking space, parking zone, or parking instructions are specified in the booking confirmation, car park signage, or communicated by the parking operator.

2.6 Customers must comply with all parking facility regulations, signage, instructions, and applicable terms of use.

3. Arrival and Departure Times

3.1 Customers may enter the parking facility only during or immediately before the booked period, subject to any grace periods that may be published by SPT from time to time.

3.2 If a vehicle enters the parking facility before the booked start time, additional parking charges may apply.

3.3 If a vehicle remains in the parking facility after the booked end time, additional parking charges shall apply.

3.4 Additional parking charges shall be calculated in accordance with the standard parking tariffs applicable at the relevant parking facility at the time of use.

3.5 Any additional parking charges incurred must be paid before departure where required by the parking facility's operating procedures.

3.6 Failure to pay additional charges may result in parking enforcement action, debt recovery proceedings, or delayed exit from the parking facility.

3.7 If a customer fails to enter the parking facility within twenty-four (24) hours of the booked start time, the booking shall automatically expire and be deemed a "No Show".

3.8 Expired No Show bookings shall be cancelled automatically and shall not be eligible for refund, credit, amendment, extension, or future use.

4. Booking Availability

4.1 All Pre-Bookings are subject to availability at the time of purchase.

4.2 SPT reserves the right to limit the number of Pre-Bookings available at any parking facility.

4.3 A Pre-Booking does not guarantee allocation of a specific parking space unless expressly stated otherwise in the booking confirmation.

4.4 Parking facilities operate on a first-come, first-served basis within the capacity reserved for pre-booked customers.

5. Account and Vehicle Information

5.1 Customers are responsible for ensuring that all booking information is accurate, complete, and current.

5.2 Customers must ensure that the correct vehicle registration number is entered during the booking process.

5.3 SPT shall not be liable for denied access, additional charges, booking failures, enforcement action, or inconvenience arising from incorrect vehicle registration details or other inaccurate information supplied by the customer.

5.4 Customers are responsible for maintaining accurate contact details and payment information within their account.

6. Vehicle Registration and ANPR Requirements

6.1 Access to participating parking facilities may rely on Automatic Number Plate Recognition ("ANPR") technology.

6.2 Customers must ensure that the correct vehicle registration number is entered during the booking process.

6.3 Where ANPR technology is used, the vehicle registration number provided during the booking process will be matched against the booking details when the vehicle arrives at the parking facility.

6.4 Where a valid booking is identified, the entry barrier may open automatically upon arrival without any action being required by the customer.

6.5 Upon departure, the ANPR system will verify the booking details and, where no additional parking charges are due, the exit barrier may open automatically.

6.6 If additional parking charges are due because the vehicle arrived before the booked start time, departed after the booked end time, remained parked beyond the booked period, or otherwise incurred parking charges not covered by the booking, the customer may be required to pay the outstanding balance before being permitted to exit the parking facility.

6.7 Customers must follow all instructions displayed at the parking facility relating to payment of outstanding charges prior to exit.

6.8 Vehicle registration plates must comply with all applicable legal and regulatory requirements and must remain clean, legible, unobstructed, and capable of being accurately read by ANPR equipment.

6.9 SPT shall not be liable where access is delayed, denied, restricted, or additional charges are incurred due to incorrect vehicle details, damaged number plates, obscured number plates, modified number plates, environmental conditions, or ANPR failures outside SPT's reasonable control.

6.10 SPT reserves the right to review, investigate, correct, amend, reverse, or remove bookings, transactions, charges, and ANPR records where it reasonably believes an error, omission, technical malfunction, fraud, misuse, or inaccurate ANPR reading has occurred.

7. Pricing and Payment

7.1 Booking prices shall be those displayed at the time of purchase.

7.2 Full payment must be received before a booking is confirmed.

7.3 SPT reserves the right to amend pricing at any time.

7.4 Price changes shall not affect bookings already confirmed and paid for.

7.5 Customers are responsible for ensuring that payment details provided are valid and capable of processing transactions.

8. Refunds, Amendments and Cancellations

8.1 All Pre-Bookings are final.

8.2 Pre-Bookings are non-refundable and non-transferable except where required by applicable law or where SPT is unable to provide the booked parking service due solely to circumstances within SPT's reasonable control.

8.3 Failure to use a booking, failure to arrive, early departure, changes in travel plans, traffic delays, transport disruptions, or customer error shall not entitle the customer to a refund, credit, or compensation.

8.4 SPT may, at its sole discretion, permit amendments to booking details where operationally possible. Any such amendment may be subject to administration fees, availability restrictions, revised pricing, or additional charges.

8.5 SPT reserves the right to cancel, amend, or correct bookings where a pricing error, technical error, fraud, payment dispute, chargeback, misuse, or system malfunction has occurred.

9. Customer Responsibilities

9.1 Customers must comply with all parking facility terms and conditions.

9.2 Customers must ensure that the vehicle is parked only within designated parking areas.

9.3 Customers are responsible for ensuring that their vehicle is roadworthy, insured, taxed, and legally permitted to be parked within the facility.

9.4 Vehicles must not be abandoned, stored, or left in the parking facility beyond the booked parking period without prior written approval from SPT.

9.5 Certain parking facilities may operate overnight access procedures, restricted access arrangements, security controls, gate access procedures, or out-of-hours entry and exit requirements.

9.6 Where overnight access is available, customers are responsible for familiarising themselves with the applicable procedures before using the parking facility.

9.7 Customers should consult the booking confirmation email, parking facility signage, or contact the relevant parking operator directly to obtain details of any overnight access arrangements, access codes, security procedures, or operational restrictions.

9.8 SPT shall not be liable for delays, denied access, restricted access, or inconvenience arising from a customer's failure to follow overnight access procedures or parking facility operating instructions.

10. Service Availability

10.1 SPT does not guarantee uninterrupted availability of any parking facility, website, App, ANPR system, payment system, or related service.

10.2 SPT may suspend, modify, withdraw, discontinue, or replace any aspect of the Pre-Booking service where reasonably necessary for maintenance, upgrades, operational requirements, legal compliance, safety requirements, or circumstances beyond its reasonable control.

10.3 SPT reserves the right to withdraw any parking facility from the Pre-Booking programme at any time.

10.4 Where a booking cannot be honoured due solely to operational reasons attributable to SPT, SPT may provide an alternative parking arrangement, booking credit, or refund at its discretion.

11. Limitation of Liability

11.1 To the fullest extent permitted by law, SPT shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic loss arising from or relating to a Pre-Booking.

11.2 SPT shall not be liable for vehicle theft, attempted theft, vandalism, accidental damage, loss of property, personal injury, business interruption, loss of profits, loss of revenue, or loss of opportunity arising from use of a parking facility.

11.3 SPT shall not be liable for denied access, booking failures, additional charges, enforcement action, or losses arising from inaccurate vehicle registration information, ANPR errors, payment failures, traffic delays, travel disruptions, customer failure to comply with these Terms, or circumstances outside SPT's reasonable control.

11.4 Customers acknowledge that ANPR technology relies on automated image capture and processing and may be affected by weather conditions, lighting conditions, vehicle positioning, dirt, damage, or other circumstances outside SPT's reasonable control.

11.5 SPT's total aggregate liability arising from a Pre-Booking shall not exceed the amount paid for the relevant booking giving rise to the claim.

11.6 Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

12. Data Protection and Privacy

12.1 SPT processes personal data, vehicle registration information, payment information, transaction records, and ANPR data for the purposes of providing and administering the Pre-Booking service.

12.2 Personal data shall be processed in accordance with SPT's Privacy Policy, as amended from time to time.

13. Amendments

13.1 SPT reserves the right to amend, update, replace, or modify these Terms at any time.

13.2 Updated Terms shall become effective upon publication on the App, website, or other communication channels.

13.3 Continued use of the Pre-Booking service following publication of revised Terms shall constitute acceptance of those revised Terms.

14. General

14.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

14.2 Any delay or failure by SPT to exercise a right or remedy shall not constitute a waiver of that right or remedy.

14.3 SPT shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, severe weather, flooding, fire, epidemic, pandemic, war, terrorism, industrial disputes, telecommunications failures, cyber-attacks, governmental actions, or failures of third-party service providers.

14.4 These Terms constitute the entire agreement between SPT and the customer relating to the Pre-Booking service.

14.5 These Terms shall be governed by and construed in accordance with the laws of Ireland.

14.6 The courts of Ireland shall have exclusive jurisdiction to hear and determine any dispute arising out of or in connection with these Terms.

14.7 All rights not expressly granted under these Terms are reserved by SPT.

15. Contact Information

15.1 Customers requiring assistance may contact SPT using the contact details published on the App or website.

By purchasing or using a Pre-Booking, customers confirm that they have read, understood, and agreed to these Terms and Conditions.
