These Terms and Conditions ("Terms") govern the purchase and use of the Pay Per Visit parking product ("Pay Per Visit Product") provided by Smart Parking Technologies Ltd ("SPT", "we", "us", or "our") through the SPT ParkEasy mobile application ("App") and associated websites, including www.spt.ie and www.bookings.spt.ie.
By purchasing, accessing, or using the Pay Per Visit Product, you agree to be bound by these Terms.
1. Pay Per Visit Product
1.1 The Pay Per Visit Product allows customers to purchase parking visits in advance through the App.
1.2 One parking visit will be deducted from the customer's account each time a registered vehicle enters and exits a participating car park.
1.3 Each parking visit permits parking for a maximum period of twenty-four (24) consecutive hours.
1.4 Where a vehicle remains parked for longer than twenty-four (24) consecutive hours, additional visits will be deducted automatically from the customer's account for each additional twenty-four (24) hour period or part thereof.
1.5 The Pay Per Visit Product is valid only at participating parking facilities designated by SPT and may be subject to site-specific restrictions or conditions.
2. Advance Purchase Requirement
2.1 Parking visits must be purchased and credited to the customer's account before entering a participating parking facility.
2.2 Customers are responsible for ensuring that sufficient visits are available on their account prior to entry.
2.3 If a vehicle enters a participating car park without sufficient visits available, the Pay Per Visit Product may not apply and standard parking tariffs may be charged.
2.4 Standard parking charges must be paid using the payment methods available at the relevant parking facility.
3. Pricing and Payment
3.1 Parking visit prices shall be those displayed within the App or on the relevant SPT platform at the time of purchase.
3.2 All purchases must be paid in full before visits are credited to an account.
3.3 SPT reserves the right to amend pricing at any time. Any change in pricing shall not affect visits already purchased and credited to an account.
3.4 Customers are responsible for ensuring that payment details provided to SPT are valid, accurate, and capable of processing transactions.
4. Use of the App
4.1 Customers must maintain an active SPT ParkEasy account in order to purchase, manage, and redeem parking visits.
4.2 Customers are responsible for ensuring that the App is correctly installed, updated, and functioning on their device.
4.3 SPT does not guarantee uninterrupted access to the App, website, payment systems, ANPR systems, or related services and shall not be liable for temporary interruptions, maintenance periods, network failures, technical issues, or events beyond its reasonable control.
5. Account Responsibilities
5.1 Customers are responsible for maintaining the confidentiality and security of their account credentials.
5.2 Customers must ensure that all account information, including vehicle registration details, contact details, and payment information, remains accurate and up to date.
5.3 Any activity conducted through a customer's account shall be deemed authorised by that customer unless proven otherwise.
5.4 SPT shall not be responsible for losses arising from unauthorised access to or use of a customer's account except where such losses result directly from SPT's negligence or wilful misconduct.
6. Vehicle Registration and ANPR Requirements
6.1 Access to and use of the Pay Per Visit Product may rely on Automatic Number Plate Recognition ("ANPR") technology.
6.2 Customers must ensure that the correct vehicle registration number is registered on their account at all times.
6.3 Customers are solely responsible for ensuring that vehicle registration details entered on their account are complete, accurate, and current.
6.4 Vehicle registration plates must comply with all applicable legal and regulatory requirements and must be clean, legible, unobstructed, and capable of being accurately read by ANPR equipment.
6.5 SPT shall not be liable where access is delayed, denied, restricted, or additional charges are incurred as a result of incorrect vehicle details, obscured number plates, damaged number plates, modified number plates, non-standard number plates, environmental conditions, or any failure of ANPR systems to identify a vehicle due to circumstances beyond SPT's reasonable control.
6.6 Vehicles fitted with non-compliant, novelty, decorative, modified, square, or otherwise non-standard registration plates may not be recognised by the ANPR system and may not qualify for Pay Per Visit benefits.
6.7 Customers are solely responsible for ensuring that the correct vehicle registration number is entered and maintained on their account. SPT shall not be liable for any loss, denied access, additional charges, parking fees, penalties, loss of visits, or inconvenience arising from inaccurate vehicle registration information supplied by the customer.
6.8 SPT reserves the right to review, investigate, correct, adjust, amend, reverse, or remove transactions, account balances, visit allocations, ANPR records, and vehicle registration records where it reasonably believes that an error, omission, technical malfunction, fraud, misuse, or inaccurate ANPR reading has occurred.
7. Validity and Use of Visits
7.1 Parking visits have no cash value and may only be used for parking at participating locations.
7.2 Parking visits may not be resold, exchanged, transferred, assigned, shared, or redeemed for cash.
7.3 SPT reserves the right to refuse, suspend, cancel, revoke, or remove visits where fraud, misuse, abuse, unauthorised activity, attempted circumvention of the service, or a breach of these Terms is suspected.
7.4 SPT reserves the right to suspend, restrict, terminate, or permanently disable any account or access to the Pay Per Visit Product where it reasonably believes that a customer has engaged in fraudulent, abusive, unlawful, or prohibited activity.
7.5 Any suspension or termination under this clause shall be without prejudice to any other rights or remedies available to SPT.
8. Refunds and Cancellations
8.1 All purchases of parking visits are final.
8.2 Parking visits are non-refundable and non-transferable except where required by applicable law.
8.3 SPT reserves the right to correct errors, cancel transactions, amend visit balances, reverse credits, or remove visits where a purchase, allocation, redemption, or account credit has occurred as a result of a technical issue, processing error, fraud, misuse, payment dispute, chargeback, or system malfunction.
8.4 Where SPT exercises its rights under this clause, SPT shall endeavour to notify the customer where reasonably practicable.
9. Automatic Top Up
9.1 Customers may elect to activate the Automatic Top Up feature for eligible vehicles and products.
9.2 By enabling Automatic Top Up, the customer authorises SPT to automatically purchase and apply additional parking visits when the remaining visit balance reaches one (1) visit.
9.3 The selected top-up bundle at the time of enrolment shall be purchased automatically each time an Automatic Top Up is triggered unless amended by the customer or SPT.
9.4 The customer's designated payment method may be charged automatically each time an Automatic Top Up occurs.
9.5 An email confirmation will be sent following successful processing of each Automatic Top Up transaction.
9.6 Customers are responsible for ensuring that their payment method remains valid, active, and capable of accepting charges.
9.7 If an Automatic Top Up payment attempt fails, SPT may suspend or disable the Automatic Top Up feature without notice.
9.8 Automatic Top Up applies only to the vehicle registration selected during enrolment.
9.9 Customers must disable Automatic Top Up if they sell, replace, transfer, or cease using the registered vehicle, or if they no longer wish to receive automatic purchases.
9.10 All Automatic Top Up transactions are final and non-refundable once processed, including where the customer forgets that the feature is enabled, intended to purchase manually, or subsequently no longer requires the visits purchased.
9.11 SPT may suspend, restrict, modify, withdraw, or discontinue Automatic Top Up functionality at any time for operational, technical, commercial, payment-related, legal, security, fraud-prevention, or site-specific reasons.
10. Service Availability
10.1 SPT does not guarantee that the Pay Per Visit Product, App, website, ANPR systems, payment services, or related systems will operate continuously or without interruption.
10.2 SPT may suspend, modify, withdraw, discontinue, or replace any aspect of the Pay Per Visit Product at any time where reasonably necessary for maintenance, upgrades, operational requirements, security measures, legal compliance, or circumstances beyond its reasonable control.
10.3 Access to parking facilities remains subject to space availability, operational requirements, site restrictions, and any conditions imposed by the owner or operator of the relevant facility. The purchase of parking visits does not guarantee the availability of a parking space.
10.4 SPT reserves the right to add, remove, suspend, or discontinue the participation of any parking facility in the Pay Per Visit Product at any time without liability.
11. Limitation of Liability
11.1 To the fullest extent permitted by law, SPT shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic loss arising from or in connection with the Pay Per Visit Product.
11.2 SPT shall not be liable for vehicle theft, attempted theft, vandalism, accidental damage, loss of property, personal injury, business interruption, loss of profits, loss of revenue, loss of opportunity, or any other loss arising from the use of any parking facility.
11.3 SPT shall not be liable for losses arising from incorrect vehicle registration details, ANPR misreads caused by dirty, damaged, obscured, modified, non-compliant, or unreadable number plates, payment card failures, telecommunications failures, internet outages, mobile device issues, software defects outside SPT's reasonable control, or customer failure to comply with these Terms.
11.4 Customers acknowledge that ANPR technology relies on automated image capture and processing and may be affected by environmental conditions, vehicle positioning, lighting conditions, weather, dirt, damage, or other factors beyond SPT's reasonable control.
11.5 SPT's total aggregate liability arising from or relating to the Pay Per Visit Product shall not exceed the total amount paid by the customer for the parking visits giving rise to the claim.
11.6 Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
12. Data Protection and Privacy
12.1 Customers acknowledge that SPT processes vehicle registration information, account information, transaction information, payment information, and ANPR data for the purposes of providing and administering the Pay Per Visit Product.
12.2 Personal data shall be processed in accordance with SPT's Privacy Policy, as amended from time to time.
13. Amendments to These Terms
13.1 SPT reserves the right to amend, update, replace, or modify these Terms at any time.
13.2 Updated Terms shall become effective when published on the App, website, or otherwise communicated to customers.
13.3 Continued use of the Pay Per Visit Product following publication of amended Terms shall constitute acceptance of the revised Terms.
13.4 SPT may amend these Terms where reasonably necessary to reflect changes in law, regulation, technology, operational requirements, commercial arrangements, security measures, or service functionality.
14. Contact Information
14.1 Customers requiring assistance or support may contact SPT using the contact details published on the App or website.
15. General
15.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
15.2 Any delay or failure by SPT to exercise or enforce any right or remedy under these Terms shall not constitute a waiver of that right or remedy.
15.3 These Terms, together with any policies or notices expressly incorporated by reference, constitute the entire agreement between SPT and the customer in relation to the Pay Per Visit Product and supersede all prior understandings, communications, representations, and agreements relating to the subject matter.
15.4 SPT shall not be liable for any failure, delay, interruption, suspension, or inability to perform its obligations under these Terms where such failure arises from events beyond its reasonable control, including but not limited to acts of God, severe weather, flooding, fire, epidemic, pandemic, war, terrorism, civil unrest, industrial disputes, power outages, telecommunications failures, cyber-attacks, governmental actions, or failures of third-party service providers.
15.5 These Terms and any dispute, claim, or matter arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland.
15.6 The courts of Ireland shall have exclusive jurisdiction to hear and determine any dispute arising out of or in connection with these Terms.
15.7 All rights not expressly granted to customers under these Terms are reserved by SPT.
By purchasing parking visits and using the Pay Per Visit Product, customers confirm that they have read, understood, and agreed to these Terms and Conditions.
